Important Notice, Disclaimer & User Consent Agreement

1. Purpose and Intended Use

This Device is designed for lawful, visible, owner-authorized remote monitoring and two-way communication in locations where the user has legal ownership, authority, or documented consent.

Intended uses include, but are not limited to:

• Monitoring your own home or property
• Communicating with family members, caregivers, visitors, or staff
• Wellness, safety, customer support, or security presence
• Pet, child, or elderly check-ins

This Device is NOT intended for covert surveillance, secret recording, or use in locations where monitoring is prohibited by law.

2. Consent and Notice Requirement (CRITICAL)

You agree that:

• All individuals present in the monitored space must be informed that a camera and microphone are in use
• The Device is physically visible and not hidden
• You are solely responsible for obtaining all required consent, including consent required by local, state, federal, or international law

The manufacturer and service provider do not obtain consent on your behalf and are not responsible for improper or unlawful use.

3. No Expectation of Privacy in Monitored Area

By using this Device, you acknowledge that:

• Live audio and video may be accessed remotely by an authorized user
• Individuals in the monitored area may be seen and heard in real time
• The Device is always powered on unless unplugged

Do not install or use this Device in bathrooms, bedrooms, changing areas, or any location where individuals reasonably expect privacy unless explicit, informed consent has been obtained.

4. User Responsibility and Legal Compliance

You agree to use the Device in full compliance with:

• All applicable privacy, surveillance, recording, and consent laws
• Property, landlord-tenant, employment, and facility regulations
• Any signage or disclosure requirements applicable in your jurisdiction

Improper use may violate civil or criminal laws. You assume all legal responsibility for how the Device is used.

5. Not a Medical or Emergency Device

This Device:

• Is not a medical device
• Does not provide diagnosis, treatment, or medical advice
• Does not replace professional caregivers, security personnel, or emergency services

In an emergency, contact local emergency services immediately.

6. Data Access and Security

• Access to the Device is controlled by user credentials
• You are responsible for maintaining the confidentiality of your login information
• The manufacturer is not responsible for unauthorized access resulting from credential sharing, weak passwords, or user negligence

7. Limitation of Liability

To the maximum extent permitted by law:

• The manufacturer and service provider are not liable for misuse, abuse, unlawful monitoring, or failure to obtain consent
• The Device is provided "as is" without guarantees of uninterrupted service
• The manufacturer is not responsible for damages resulting from installation, internet failure, power outages, or third-party actions

8. Acceptance of Terms

For Printed Version (Included in Package):
By installing or using the Device, you confirm acceptance of this Disclaimer and User Consent Agreement.

For Website / Account Creation:
You must affirmatively accept this agreement (checkbox + timestamp) before creating an account or accessing the Service.

1. HIPAA-Aligned Privacy & Security Safeguards

Doctor AI implements HIPAA-aligned administrative, technical, and physical safeguards designed to protect sensitive information, including encrypted access controls, authenticated user credentials, and audit-ready system design.

• The system does not listen to or record conversations unless a live video/audio session is actively initiated
• There is no hidden or background audio monitoring
• Live video and audio are accessible only during an active remote session

Doctor AI does not sell, share, or monetize live audio or video content.

2. No Hidden Surveillance – Always Visible Use

Doctor AI's system is intentionally designed to prevent covert or hidden surveillance.

When any user—authorized or unauthorized—accesses the Device:

• The camera indicator light turns ON
• The remote user's live video appears on the device screen
• Two-way visibility is automatic and cannot be disabled

This ensures that individuals in the monitored space are visually alerted whenever the Device is being accessed.

There is no silent mode, no invisible viewing, and no background monitoring.

3. Protection Against Unauthorized Access

Even in the unlikely event that a user ID or password is compromised:

• The camera indicator light will activate
• The remote user will be visibly displayed on the device screen
• The on-site person will be aware that access is occurring

If you believe someone may have accessed your Device without authorization, you must:

1. Immediately reset your user ID and password
2. Notify Doctor AI without delay so we can investigate and assist

4. Doctor AI Will Never Ask for Your Password

Doctor AI will never call, text, or message you requesting your user ID or password.

If troubleshooting or support is required:

• Doctor AI will contact you by email
• Any remote access will occur only during a scheduled video session
• You must be physically present in front of the Device
• You will be able to see and hear Doctor AI support staff at all times

At no point will Doctor AI access your Device without your knowledge or visibility.

5. User Responsibility & Consent

This system is intended only for use in locations you own, control, or where you have obtained explicit consent.

You are responsible for:

• Informing occupants that live video and audio monitoring may occur
• Using the Device in compliance with local, state, and federal privacy laws
• Avoiding installation in areas with a reasonable expectation of privacy (e.g., bathrooms, changing areas)

Doctor AI does not authorize covert monitoring or use without consent.

6. Addressing Privacy & Unauthorized Surveillance Concerns

We recognize that on-demand remote access—without requiring acceptance from the on-site person—is a powerful feature and must be used responsibly.

To mitigate privacy concerns:

• The Device is always visible
• Monitoring is never hidden
• The system includes mandatory visual alerts
• Two-way visibility is enforced

Doctor AI expressly prohibits use of this system for spying, stalking, or unauthorized surveillance.

7. If You Do Not Agree

If you do not agree with these privacy safeguards and responsibilities, do not install or use the Device.
